Vanuatu leads a campaign to ensure countries comply with climate change commitments following a landmark ICJ ruling. The initiative seeks a UN General Assembly resolution endorsing the Advisory Opinion and its practical implementation.
A significant diplomatic push is currently unfolding at the United Nations General Assembly, aimed at ensuring nations uphold their climate change commitments. This effort follows a pivotal Advisory Opinion issued by the International Court of Justice ( ICJ ) in July. The ICJ , the preeminent international court, unanimously concluded that a failure by countries to act on their climate change pledges could constitute a violation of international law.
This landmark ruling emerged from a campaign initiated by the small island nation of Vanuatu, highlighting the vulnerability of low-lying territories to the effects of climate change and their determination to hold larger nations accountable. Vanuatu's proactive stance signifies a shift in the climate change discourse, emphasizing the legal obligations associated with international agreements and the potential for enforcement. Having achieved this crucial legal victory, Vanuatu is now spearheading a campaign to secure a UN General Assembly resolution that formally endorses the ICJ's findings. The aim is to solidify the Advisory Opinion's implications within the framework of the UN and encourage its practical application by member states. \Speaking exclusively to Newsweek, Ralph Regenvanu, the Minister for Climate Change of Vanuatu, expressed optimism about the resolution's prospects. He confidently stated, 'You need a simple majority of states, and we have that.' This confidence underscores the support Vanuatu has garnered from other nations concerned about climate change, and the increasing recognition of the urgency to address it. The resolution is anticipated to be voted on later this year, and Vanuatu, along with its allies, has been actively building alliances throughout the week-long UN General Assembly gathering in New York. Their primary objective is to gather support for a resolution that would not only endorse the Advisory Opinion but also advocate for its operationalization within the UN system and in member states. Regenvanu elaborated on the coalition-building efforts, stating, 'We are building a coalition of the willing to take that resolution forward, so that we can start to see implementation of some of its recommendations in the UN system itself and in some states as well.' The emphasis on enforcement mechanisms highlights the shift from mere declarations to concrete actions in combating climate change. During an interview on the Climate Week NYC Daily Show, Regenvanu emphasized the legal significance of international agreements, specifically referencing the Paris Agreement. He stated, 'We are saying that these things we sign up to, like the Paris Agreement, these are legal instruments. You are legally obligated. What has been happening is we haven't seen the action to match the commitments that have been made.'\The Advisory Opinion from the ICJ, according to Regenvanu, provides a crucial legal framework for holding nations accountable. It reinforces the binding nature of climate change commitments and equips climate advocacy groups and individuals with a potent tool. This is especially relevant in the context of non-compliant countries, where citizens and organizations can now leverage the Advisory Opinion in legal proceedings at both domestic and international levels. The ICJ ruling provides a foundation for stronger negotiations and a clear legal basis for demanding action. Regenvanu believes this ruling will be especially useful in forums like COP30. 'We've seen with this Advisory Opinion, it says when you make a commitment you are obliged under international law to do it. That will give us a lot more strength to negotiate in these forums, for example like COP30 coming up this year.' This enhanced legal standing will empower climate action advocates and provide legal avenues for those impacted by climate change. Newsweek is actively participating in the 2025 Climate Week in New York City with a series of events throughout the week. The events, including 'Pillars of the Green Transition' on September 24th and 'Powering Ahead: Innovations in Energy and Plastics Technology' on September 25th, will take place at Newsweek's global headquarters at One World Trade Center in New York City. The focus on these themes will continue to help drive discussions surrounding climate change solutions and promote new innovations to help the world deal with a changing climate
