The lawsuit states that the club was aware of the dangerous nature of their activities but failed to take reasonable steps to reduce or prevent further harm. It also alleges that the club received multiple complaints about their behavior, including encouraging dangerous behavior by failing to monitor alcohol consumption among shooters. The lawsuit cites another case where a man riding his bike near the Leon Greenway Creek claimed a stray bullet from the gun club struck his helmet, causing him to fall off his bike. However, that lawsuit was recently dismissed. Despite the allegations, the gun club's attorney maintains that they have always prioritized safety and that the plaintiffs do not have credible evidence. He also stated that the club was not approached by the school prior to their filing. Adding to the legal battle, Acton Academy North San Antonio, a private school located off W Hausman Road, filed a petition to join the lawsuit on January 10. While the school doesn't claim to have found bullets or projectiles on their property, they are joining the case to ensure the safety of their students. The attorney representing the school, Stephen Foster, emphasizes that they are not against gun rights but are fighting for gun responsibility. They are not seeking financial compensation, but simply want to ensure the children's safety. The case is scheduled for a hearing on January 27th, where a judge will decide whether the gun club can resume normal operations. Meanwhile, SA Given to Fly is seeking over $1 million in damages from the club and demanding a jury trial
