A federal judge has struck down the Biden administration's attempt to revise Title IX nationwide, citing concerns over its constitutionality and exceeding authority.
A federal judge on Thursday rejected the Biden administration's attempt to revise Title IX nationwide after months of legal battles. The U.S. Department of Education released its final Title IX regulations in April. The new rules, initially slated to take effect in August, expanded the 1972 federal civil rights law to prohibit discrimination based on sexual orientation and gender identity in educational institutions receiving federal funding.
The rewrite also reversed several regulations concerning the handling of sexual assault complaints, including broadening the definition of sexual harassment. The challenged rules were enacted during President-elect Donald Trump's first term. The Biden administration's rewrite faced immediate legal challenges, with numerous courts last year temporarily blocking it in dozens of states over claims of unconstitutionality. The U.S. District Court Eastern District of Kentucky Northern Division ultimately ruled Thursday that the new regulations 'exceed' the Department of Education's 'authority under Title IX,' as well as violate the Constitution. The entire rewrite, spanning 1,500 pages, was 'fatally' flawed due to legal challenges, according to the ruling. 'As the Court has explained, the definition of discrimination 'on the basis of sex' lies at the heart of Title IX and permeates virtually every provision of the law,' U.S. District Judge Danny C. Reeves wrote in the ruling. Tennessee Attorney General Jonathan Skrmetti, whose state challenged the rewrite, called the ruling a 'massive win' in an X post Thursday. 'The court's order is a resounding victory for the protection of girls' privacy in locker rooms and showers, and for the freedom to speak biologically-accurate pronouns,' Skrmetti wrote. Rep. Mary Miller, R-Ill., also celebrated the decision in a press release, stating 'parents when you speak up, we win.
