Ken Buck floats proposal to remove Biden through 25th Amendment

The push comes after a special counsel report released this month called into question President Joe Biden’s cognitive abilities, particularly his memory.

House Republicans are increasingly calling for President Joe Biden’s removal from office, with one GOP lawmaker floating a proposal to invoke the 25th Amendment overwhich would effectively remove Biden from the presidency and instate Vice President Kamala Harris to the Oval Office in his place.

The push comes after a special counsel report released earlier this month called into “Numerous instances were articulated in the report, and have played out in full public view, showing President Biden’s apparent cognitive decline and lack of mental stamina,” Buck said in a statement. “The societal challenges and security threats our country faces are innumerable and require a chief executive with both strong mental and physical faculties. The time has come for the vice president and the Cabinet to put our country first and move forward on invoking the 25th Amendment.” The resolution comes after special counsel Robert Hur released the long-awaited findings of his investigation into whether Biden mishandled classified documents after leaving the White House in 2017. Although the report did not result in criminal charges, the special counsel noted that was partly due to Biden’s ability to portray himself as “a sympathetic, well-meaning elderly man with a poor memory.” Buck also cited several recent instances in which Biden has made verbal gaffes and mistaken the names of current world leaders for those who died decades ago. One of those flubs even came during a press conference in which Biden sought to admonish the special counsel report challenging his memory. When asked a question about the war in Gaza, Biden responded that “initially, the president of Mexico, el Sisi, did not want to open up the gate to humanitarian material to get in. I talked to him. I convinced him to open the gate.”A sitting president has never been removed from office through Section 4 of the 25th Amendment, which allows executive officials to declare the president unfit to complete his or her duties. In order to be successful, the vice president must also agree to the proposal. Biden would have the opportunity to challenge his removal by writing to Congress that he is fit to serve. Cabinet members calling for his removal would then have four days to dispute that, after which Congress would hold a vote on whether to remove him. Buck’s decision to move forward with such a proposal is also notable as the retiring Colorado Republican has often expressed hesitancy with separate efforts to impeach Biden and remove him from the White House that way. “I want to make sure we don’t ruin this institution over a tit-for-tat impeachment. If the evidence is there, I will absolutely vote for impeachment. I don’t see the evidence at this point,” Buck told CNN last year. A handful of other Republicans have called for Biden’s removal through the 25th Amendment, including Sens. Rick Scott and Mike Lee and Reps. Mary Miller and Mike Collins .
