Governor Greg Abbott has called for a special legislative session next month to address bills he vetoed just before his midnight deadline. That includes Senate Bill 3 , the bill aimed to ban THC products containing Delta 8 and Delta 9 , a measure that was a top priority for Lieutenant Governor Dan Patrick.
Abbott's veto has put him at odds with Patrick, who criticized the decision in a post on social media late last night. Patrick said, " late-night veto backed by many in the medical and education communities, and families who have seen their loved one’s lives destroyed by these dangerous drugs, leaves them feeling abandoned." In a statement explaining his veto, Abbott said, "Allowing Senate Bill 3 to become law, knowing that it faces a lengthy battle that will render it dead on arrival in court, would hinder rather than help us solve the public safety issues this bill seeks to contain." Abbott's decision came amid increasing political pressure from both sides. Opponents of the bill argue it threatens thousands of jobs and could shutter a multi-billion-dollar industry. Supporters contend that the products are harmful and threaten public safety. Lieutenant Governor Patrick has been vocal about his opposition to the industry, stating in a May press conference, "There's a tremendous onslaught of pressure from an 8-billion-dollar industry that has unlimited money, and they're trying to poison the story. These are people who want to kill your kids. And they don't give a damn." Patrick, who has made this measure one of his most visible priorities, plans to hold a press conference Monday to discuss the issue further. Abbott's office said of the 26 bills he vetoed this session, including SB 3, five others will be taken up during the upcoming special session. Those include: Senate Bill 648: Relating to recording requirements for certain instruments concerning real property. Senate Bill 1253: Relating to impact and production fees for certain water projects and to the regulation of certain wells; authorizing a fee. Senate Bill 1278: Relating to an affirmative defense to prosecution for victims of trafficking of persons or compelling prostitution. Senate Bill 1758: Relating to the operation of a cement kiln and the production of aggregates near a semiconductor wafer manufacturing facility. Senate Bill 2878: Relating to the operation and administration of and practices and procedures related to proceedings in the judicial branch of state government. According to the state constitution, during a special session, lawmakers can only pass bills on issues the governor has selected. Abbott can still add items to the call list.
