A federal judge has halted the Biden administration's attempt to revise Title IX, ruling that the new regulations exceed the Department of Education's authority and violate the Constitution.
A federal judge on Thursday struck down the Biden administration's attempt to rewrite Title IX nationwide after months of legal challenges. The U.S. Department of Education in April released its finalized Title IX regulations. The new rules, originally set to go into effect in August, broadened the 1972 federal civil rights law to prohibit discrimination based on sexual orientation and gender identity in educational institutions receiving federal funding.
The rewrite also reversed a number of rules targeting the handling of sexual assault complaints, including expanding the scope of what constitutes as sexual harassment. The rules at question were enacted under President-elect Donald Trump's first term in the White House. The Biden administration's rewrite was almost immediately met with legal challenges, with multiple courts last year temporarily blocking it from dozens of states over claims it was unconstitutional. The U.S. District Court Eastern District of Kentucky Northern Division ultimately ruled Thursday the new regulations 'exceed' the Department of Education's 'authority under Title IX,' as well as violate the Constitution. The entire rewrite, spanning 1,500 pages, was 'fatally' tainted through the legal challenges, according to the ruling. 'As the Court has explained, the definition of discrimination 'on the basis of sex' lies at the heart of Title IX and permeates virtually every provision of the law,' U.S. District Judge Danny C. Reeves wrote in the ruling. Tennessee Attorney General Jonathan Skrmetti, whose state challenged the rewrite, called the ruling a 'massive win' in a post via X Thursday. 'The court's order is a resounding victory for the protection of girls' privacy in locker rooms and showers, and for the freedom to speak biologically-accurate pronouns,' Skrmetti wrote. Rep. Mary Miller, R-Ill., also celebrated the decision in a press release, noting 'parents when you speak up, we win.
