The US Department of Justice ( DOJ ) has filed lawsuits against four Democratic-led states - Massachusetts, Oregon, Washington, and Maine - for restricting the issuance of confidential license plates to federal immigration agencies, such as Immigration and Customs Enforcement (ICE) and Customs and Border Protection (CBP).
The DOJ claims that these policies put law enforcement officers at risk and undermine federal immigration enforcement, allowing dangerous criminals to escape justice and terrorizing American communities. The states' refusal to rescind the plate restrictions has resulted in the lawsuits, which seek to declare the policies unconstitutional and invalid under the intergovernmental immunity doctrine within the Supremacy Clause.
The DOJ argues that federal agencies rely on these plates to stay safe while performing their official duties and that the states' actions are discriminatory and obstructionist. Prosecutors are requesting that the program be resumed for federal agents, as it has continued for state and local agencies.
