Governor Kay Ivey has signed a bill that outlaws vaping in public places.
- The air is about to become cleaner in public places in Alabama . That’s because Governor Kay Ivey signed a bill that outlaws vaping in public places, such as restaurants, treating it the same as smoking.
It started with Senator Gerald Allen of west Alabama. The year was 2022 when Senator Allen was attending his grandson’s football game. The senator saw a man vaping in the stands.“Sitting in that public place, a public setting, and this gentleman was vaping and I inhaling his vaping fumes,” said Allen.“I said, you know you’re breaking state law by smoking. He said ‘no, sir. I’m vaping’. He said ‘I’m not breaking the law,” said Allen.
It turns out the vaper was correct, but Allen still felt the anti-smoking law in public places needed to be strengthened to include vaping.“So we tagged vaping on that piece of state law,” said Senator Allen.“A restaurant, a courthouse, a sporting goods store or a little league ballpark,” said Allen.“I agree it’s a freedom of choice, they have the right to vape, but at the same time they need to be mindful of the people around them,” said Allen.
Meanwhile, the American Heart Association in Birmingham weighed in and said in part: “All Alabamians deserve these protections which is why a comprehensive smoke-free law that includes all workplaces, bars and restaurants is still needed.”The chance meeting four years ago at a football game was all it took to push the new vaping law over the goal line. Another tidbit: Senator Allen says this bill actually passed last year, but got bogged down with some other issues and never made it out of both houses until this month.
