"A lot of people started abandoning their properties, they just couldn't afford them anymore." Brown said San Antonio presents unique challenges in these cases, because military members often leave their homes vacant while they're deployed, and property managers don't always follow up. That leaves them vulnerable to squatters.But, of all the evictions her deputies handle, Brown said squatting cases only make up a small portion.Someone can only claim adverse possession in Texas if they meet certain sets of requirements, laid out in Texas. Prop. Code 16.024-16.026.Occupy the property with color of title for at least three consecutive years. Occupy the property, have a recorded deed in their name, pay all property taxes, and cultivate the land for at least five consecutive years. Occupy the property and improve the land for at least ten consecutive years. Hostile/Adverse Possession: no valid lease or rental agreement with the owner.Open and Notorious Possession: The squatter’s presence is open and obvious, they aren't trying to hide their presenceContinuous Possession: Must hold continuous possession of the property for 3-10 years.The home on Morningview is an example of how the court process has worked, Brown says.Regularly check on your unoccupied propertiesMake sure agreements with contractors or workers are explicit and clear We also spoke with Precinct 2 officials who say they use that same eviction process for squatting situations.
