Alabama Special Primaries Announced After U.S. Supreme Court Vacates Lower Court Order

Four congressional districts in Alabama will hold special primaries on August 11 after the U.S. Supreme Court vacated a lower-court order requiring the state to use a court-ordered congressional map.

The special primaries will be held in congressional districts 1, 2, 6 and 7 using the state’s congressional map drawn in 2023. Every voter in Alabama will still be able to head to the polls on May 19, but voters in districts 1, 2, 6 or 7 will now have an additional election in August for their congressional representative.

The Supreme Court cleared the way for Alabama to use its own congressional map, which means some voters are changing districts and the representatives they vote for in Congress.

“Some voters in Jefferson County are going to go from district 6 to district 7 and some in congressional 7 are going to go to congressional 6,” said Barry Stephenson, Jefferson County Board of Registrars chairman. Stephenson said the Jefferson County Board of Registrars will mail a notice to voters affected by the change. Alabama Secretary of State Wes Allen said much stays the same for the upcoming primary election on Tuesday.

“Votes for statewide constitutional offices, local races, state legislative and judicial races, as well as statewide constitutional amendments will count on May the 19th,” Allen said. The change for those living in congressional districts 1, 2, 6 and 7 is that congressional votes Tuesday will be tabulated and released but will not count. Instead, voters in those districts will have an additional Election Day on August 11, depending on who qualifies under the new map.

“We’re seeing what happens. Qualifying opens on next Wednesday the 20th and closes May 22 so we’ll see who qualifies. We’ll see if we have an actual election. It’s a winner take all.

No run off. So it’s an August 11 special congressional election in the state,” Stephenson said. Stephenson said there are unknowns right now, but one thing he is certain of is that voters should participate. Stephenson said a full county-wide election in August would cost taxpayers more than $100,000.
