A 44-year-old father-of-two has become the first person in Britain to be convicted under new sex-based harassment laws after cornering a young woman on a train, grabbing her hair, and asking if he could kiss her.
David Stroud, from Dartford, Kent, subjected the lone female passenger to what prosecutors described as sexually motivated behavior during a late-night train journey to London just days after the legislation came into force. The incident occurred on April 3, when the woman was traveling alone on a train from Hastings at around 8:50 pm while speaking to her boyfriend on the phone.
Stroud sat beside her and began trying to start a conversation, which the victim attempted to ignore because she was a lone woman traveling at night. According to prosecutor Paul Okebu, Stroud became increasingly intrusive, constantly leaning onto the woman before moving closer and telling her, you're magical, while grabbing her hair. The woman perceived his actions as sexual and felt deeply uncomfortable, especially as she could smell alcohol on his breath.
She repeatedly told Stroud to stop touching her hair, but he persisted, asking, can I kiss you? to which she replied, absolutely not. Stroud then told the victim, you're never going to find someone who loves your hair as much as I do, prompting her to reply, I already have someone. The woman's boyfriend overheard the exchange over the phone and alerted British Transport Police, who arrested Stroud when the train arrived at London Bridge station.
While under caution, Stroud insisted it was just banter and claimed he had done nothing wrong. However, his defense lawyer, Alex Chowdhury, told the court that Stroud, a technician at a water company, had reflected on his actions and realized it was more than just banter. The magistrates described the incident as a serious offense, noting that it could have amounted to sexual assault under different circumstances.
They ordered a pre-sentence report, and Stroud will be sentenced at Highbury Corner Magistrates' Court on June 9. The new offense, under Section 4B of the Public Order Act 1986, criminalizes intentional harassment directed at someone because of their sex, including targeting women and girls in public places such as streets, parks, and public transport.
British Transport Police (BTP) previously stated that the new section strengthens existing public order powers by criminalizing behavior that causes intentional harassment, alarm, or distress because of a person's sex or presumed sex. When the change in the law was announced, safeguarding minister Jess Phillips emphasized that harassing someone in public because of their sex would not be tolerated and could result in a criminal record and up to two years behind bars
