Rodney Hinton Jr. killed Deputy Larry Henderson by deliberately driving into him on May 2, prosecutors say
CINCINNATI - The man accused of murdering a Hamilton County deputy returns to court Wednesday and is expected to change his plea of not guilty to not guilty by reason of insanity. A court-appointed psychologist recently examined Rodney Hinton Jr .
and determined he suffers from a serious mental illness that impairs his rational judgment, according to his attorney, Clyde Bennett II. The outcome of that expert’s report, Bennett maintains, clearly shows Hinton, 38, is now ineligible for the death penalty under Ohio law. The court-appointed certified forensic psychologist found Hinton had a combination of serious mental illnesses at the time he committed the offense and those serious mental illnesses significantly impaired his ability to exercise rational judgment, according to Bennett.The psychologist is scheduled to take the witness stand and testify. Hamilton County prosecutors sought a second opinion from another court-appointed certified forensic psychologist who is expected to testify at a hearing next month.Hinton, 38, is facing a possible death sentence if convicted on charges of aggravated murder, murder and felonious assault in the May 2 slaying ofIf it is determined that Hinton suffered from serious mental illness when he killed the veteran law enforcement official, however, the death penalty as a possible sentence is barred under Ohio law. Hamilton County Prosecutor Connie Pillich isn’t commenting on this until the hearings on Hinton’s mental competency are complete, her spokeswoman told us in October.In a terrible tragedy that stunned the Tri-State and nation, Deputy Henderson was killed May 2 as he worked traffic control for the University of Cincinnati’s graduation ceremony. In addition to devoting his life to protecting and serving the community, Deputy Henderson, 57, was a U.S. Marine, husband, father, grandfather and foster parent.They say he intentionally drove a vehicle into the 33-year veteran of the Hamilton County Sheriff’s Office. It was the first time in the 233-year history of Greater Cincinnati law enforcement that an officer was targeted for no reason other than that he wore a badge, according to theBennett, however, has insisted from the start that Hinton was not in his right mind at the time.being fatally shot by a Cincinnati police officer one day prior.
