In an ongoing legal battle, Anchorage School District Superior Court Judge Una Gandbhir has dismissed the temporary injunction against the closure of Campbell STEM Elementary School, ruling that the school board did not consider a private grant when making the decision.
ANCHORAGE, Alaska - An Anchorage Superior Court Judge ruled in favor of the Anchorage School District Monday and lifted the temporary injunction preventing the closure of Campbell STEM Elementary, throwing another turn into the ongoing legal battle .was first granted by Superior Court Judge Una Gandbhir, who also issued the dissolution, on May 1 after the Court heard from the Campbell STEM Preservation & Education Foundation four days prior.
Judge Gandbhir found one concern raised by the plaintiffs compelling: that the school board may not have factored in a private grant to Campbell STEM when it voted to close the school in February. At Tuesday’s School Board meeting, ASD Superintendent Jharrett Bryantt addressed that claim, denying there was an awarded grant.
According to Bryantt and the district’s chief financial officer, two grants were under discussion, one applied for and not awarded, and a second was in the process of being drafted but was never submitted. The application process was halted after the board voted to close the school.
“The board was made aware of that information on April 6,” Bryantt said, referring to a superintendent’s update at that month’s regular board meeting. As the district and school board have complied with the court’s order, the decision to dissolve the preliminary injunction was made. A previously scheduled status hearing is set to be held at 8:30 a.m. Thursday..
