Legal experts said the number of victims and Miller’s statements to investigators could play a significant role in how the case moves forward. Reports indicate Miller previously faced charges in Iowa. Evershed said a defendant’s criminal history can become important if a case moves into the sentencing phase, particularly in a potential death penalty trial. “Should this go to a death penalty case, the jury would hear about history and about these prior incidents,” Evershed said. Under Utah law, prosecutors must first prove aggravated murder before the death penalty can be considered.
