For the first time since 2019, the El Paso Walmart shooter Patrick Crusius appeared in state court on Thursday.A district judge had waived his in-person court appearance s.Judge Sam Medrano ordered another hearing on Oct. 31 to go over the claims made by the defense about the alleged misconduct done by the prosecution team.Crusius was convicted last year on federal charges against him for the death of 23 people from the Aug. 3 shooting at Walmart in Cielo Vista.
Crusius's lawyers filed a motion a couple of days ago asking to dismiss the capital murder charge and assault charges and also to eliminate the death penalty claiming there had been misconduct on the part of the prosecution such as improper witness contact, ongoing violations of the court gag order, impression of evidence, and deceptive evidence sharing practices.Crusius did appear in public on his federal sentencing but cameras were not allowed in federal court.
Crusius is accused of shooting and killing 23 people and injuring several others on August 3, 2019, at the Walmart next to Cielo Vista in east El Paso. Crusius's state charges include capital murder and if convicted he could possibly get the death penalty.
