Jacobe Ferguson says wearing an ankle monitor and living under house arrest for nearly a year has slashed his income and damaged his mental health.
The man accused of setting the 2018 fire that killed five people at the Iconic Village Apartments in San Marcos has asked a judge to ease his bail conditions, saying that living under an 8 p.m. curfew and wearing an ankle monitor for nearly a year has damaged his mental health. Jacobe De Leon O Shea Ferguson , 31, of Austin , was arrested in July 2023 and charged with arson causing death or bodily injury.
Mattress dispute led to deadly fire, affidavit says By joint motion of the prosecution and defense, Ferguson was released on a personal bond in September, but was required to wear a GPS monitor and remain at home from 8 p.m. to 6 a.m. daily. A magistrate set bail at $250,000, which was later raised to $400,000. Nearly a year later, the case against Ferguson has not budged. Prosecutors have given no indication when they will seek an indictment or when Ferguson might be brought to trial.
News of suspect’s release leaves families' 'heartbroken beyond words' In an attached affidavit, Ferguson said the conditions of release 'have severely limited my ability to function on a daily basis and are causing me mental health issues.' He said he had been forced to take a warehouse job 'that does not use my degree' and was making 'significantly less money' than before his arrest.
