The U.S. Supreme Court will not hear a case brought by a former McKinney resident, 80-year-old Vicki Baker, seeking compensation after her home was heavily...
Police raided her home in 2020 to find a fugitive, and she was left with the bill. The country’s highest court says the case brings up a constitutional question but declined to answer it – for now.Vicki Baker poses in her McKinney home. Baker, now 80, has been fighting for more than four years and said she’s living off social security with $500 left in her retirement fund. The rest went to covering her expenses and repairing her home, which she said she had to sell for under-market value.Baker said the Supreme Court’s decision brought her to tears. She remembers a city employee telling her she “will not ever see a dime” of what she feels is just compensation.
Police tried to draw Little out by launching dozens of tear gas grenades into the home, detonating explosives to break down the doors and using a tank-like vehicle to bulldoze a fence, according to the statement. By the time the officers entered, Little had killed himself.Justice Sotomayor’s statement said there is agreement that McKinney police acted properly to prevent harm to themselves and the public.
“The Fifth Amendment’s ‘just compensation’ clause is designed to make sure that public burdens are spread across society as a whole and not dropped on random, unlucky individuals,” Redfern said. “That’s exactly what’s going on here.” Baker asked the Supreme Court to consider reversing this ruling and the court declined to hear the case.
