In a March 20, 2026 letter, the Alabama Department of Environmental Management notified developer Robert Wilkes that the Preserve at Moccasin Bayou is still violating a consent order issued earlier this year.
The agency says a March 13 inspection found “continuing non-compliance” with both the consent order and state environmental regulations.Failure to properly implement erosion and sediment controls, allowing polluted stormwater runoff Failure to establish temporary ground cover in inactive construction areas to prevent sediment discharge The department says the developer must take immediate corrective action and submit required documentation within 10 days, including calculations on sediment loss into nearby wetlands and Moccasin Bayou. ADEM also directed Wilkes to schedule a meeting within two days to address the violations and warned that continued non-compliance could result in additional enforcement actions, including increased civil penalties. The letter is a follow-up to a consent order issued in January that required the developer to implement fixes and meet specific deadlines. The development has already drawn scrutiny.
