A preliminary injunction hearing is scheduled for 9:30 a.m. Dec. 18 before U.S. District Judge Xavier Rodriguez.

Southwest Airlines and the city of San Antonio are slated to return to federal court in December as they continue to fight over gate assignments in a yet-to-be built terminal a t San Antonio International Airport. Southwest and the San Antonio airport are brawling over a lease agreement that went into effect Oct. 1 because it keeps the airline out of the planned Terminal C , a $1.7 billion, 17-gate facility that’s slated to open in 2028.

Judge rejects Southwest Airlines' bid to block new lease at San Antonio airport Southwest claimed in a lawsuit filed last month against the Airport Director Jesus Saenz and the city that Saenz told the airline it would get all, or most, of the 10 gates it requested in Terminal C. But Southwest alleges that it was told in May it would remain in the airport’s oldest facility. The city’s response, filed last week, rejects that claim.

Southwest accuses city of 'bait and switch' in lawsuit over airport lease The refusal means that Southwest is incurring higher fees to operate out of the airport on a month-to-month basis. It could be difficult for Southwest attorneys to convince Rodriguez to grant a preliminary injunction that would block the new lease agreements and gate assignments from continuing as planned.

'Slap in the face: ' San Antonio Airport-Southwest standoff could hurt both sides The city said in its filing last week that it would lose $1.2 million each month if the new lease agreement didn’t go into effect, and that the city’s plans to open a new terminal in 2028 would also be delayed. Without a long-term lease, Southwest could pay $6 million in additional fees and lose out on $4 million in revenue sharing if the airline doesn’t sign a lease in the next year.
