A jury is deciding the punishment for Jesus San Miguel, who was convicted of criminally negligent homicide in the death of Joshua Kinnaman. San Miguel's mother testified about his plans for college and his good character before the fatal fight.
A jury returned to court on Wednesday to hear more about Jesus San Miguel, 20, and the fellow John Jay High School student, Joshua Kinnaman, 18, that he fatally stabbed in April of 2023. A previous jury found San Miguel not guilty of murder, but convicted him of a lesser charge of criminally negligent homicide. That jury was unable to come to a decision on punishment, so the newly empaneled jury will decide San Miguel's punishment.
San Miguel's mother tearfully told jurors her son had visited Louisiana State University two weeks before the fatal fight that occurred in a restaurant parking lot across from John Jay High School where the two were seniors. She said her son was awarded a scholarship and had already selected where he would live, but those plans were derailed as he battled a murder charge. San Miguel's mother also testified that her son was performing well in school leading up to the fight, and shared that he had never violated conditions of his release, including GPS monitoring and drug testing. Prosecutors, however, challenged that characterization and asked about a fight San Miguel had previously been suspended from school for two days over. San Miguel's defense attorneys also called Dr. Richard Theis to testify about San Miguel’s psychological profile. Dr. Theis reviewed video of the deadly fight, and conducted a number of behavioral assessments of San Miguel in preparation for the punishment phase of trial. 'From the data that I have, his profile is inconsistent with someone who is going to have problems psychologically, with reoffending, anger control, those kinds of issues,' Dr. Theis told jurors. Dr. Theis also testified that he did not believe San Miguel was the aggressor in the fight that led to Kinnaman's death
