Sunnyvale men were charged with murder in the shooting death of 19-year-old Daniel Guizar on Madera Avenue.
SAN JOSE — Two Sunnyvale men have been arrested in connection with a fatal shooting Halloween weekend at a San Jose house party that elicited controversy after police saidRodolfo Perez-Damian, 22, and Edgar Mauricio Merlo Martinez, 20, were arrested Dec. 21 in Sunnyvale following an investigation into thethat claimed the life of 19-year-old Daniel Guizar, according to San Jose police.
At the time of the shooting, a San Jose police bulletin obtained by Bay Area News Group and later publicized widely by the police union stated that officers were not sent to a music disturbance complaint made just after 11 p.m. Oct. 29 in the 500 block of Madera Avenue, off North 10th Street. The bulletin added that officers were already handling other calls, which includedOfficers were sent to Madera Avenue about two hours later for a shooting report, and found Guizar gravely wounded.
An ensuing investigation by homicide detectives identified Perez-Damian and Merlo Martinez as the primary suspects, and police obtained arrest warrants for the two. Other people appear to have been implicated in the shooting but their roles have not been publicly stated. Perez-Damian and Merlo Martinez were booked into the Santa Clara County Main Jail where they were being held without bail, according to jail records. They were both charged with murder and were arraigned Friday; their next court appearance is scheduled for Jan. 13.
Police have not disclosed any known connection between the defendants and Guizar, a San Jose resident who friends say attended the house party with his cousins and was the victim of being in the wrong place at the wrong time.
