Representative Tracey Mann (R-KS) is introducing legislation titled the RIFLE Act to address the Bureau of Alcohol, Tobacco, Firearms and Explosives' ( ATF ) controversial ' zero tolerance ' policy. This policy, implemented under the Biden Administration, led to the closure of numerous small and mid-sized gun stores due to minor clerical errors in their licensing applications.
The ATF revoked Federal Firearm Licenses (FFLs) for infractions such as omitting a customer's middle initial or using a state abbreviation instead of the full name. In 2024 alone, the ATF saw the highest number of gun store license revocations in 20 years, marking the third consecutive year of increased revocations under President Biden's leadership. While the Biden Administration recently claimed to have reversed its 'zero tolerance' policy, Rep. Mann expressed skepticism, stating that the ATF's actions on the ground indicate otherwise. He asserts that the Biden Administration weaponized the federal government against gun store owners, undermining the Second Amendment and trampling on the constitutional rights of law-abiding citizens. Mann emphasized his commitment to fighting against this unconstitutional policy and pushing for greater oversight of the ATF's actions.The RIFLE Act aims to rectify these concerns by requiring the ATF to collaborate with FFLs, providing them with an opportunity to rectify any issues before facing license revocation. It also clarifies and strengthens the definition of willful violations, establishing a presumption of innocence unless clear and convincing evidence of intent is presented. The bill further allows FFLs to appeal ATF decisions before an administrative law judge and provides reimbursement for legal fees incurred during the implementation of the 'zero tolerance' policy. Additionally, the RIFLE Act automatically reinstates and approves licenses that were suspended, revoked, or denied while the 'zero tolerance' policy was in effect. Gun Owners of America (GOA) Director of Federal Affairs, Aidan Johnston, applauded the bill, stating that it is crucial to rein in the ATF's attacks on the Second Amendment.
