Penn State alleges it had to pay more than was reasonable to provide health insurance to employees over the diabetic drug duplicity.
Penn State University has sued several pharmaceutical companies alleging they conspired to inflate the price of insulin and other drugs the university paid for through its insurance program. The university alleges the companies have spent the past two decades artificially inflating the price of diabetes medication by tenfold to increase their profits at the expense of the university.
Penn State University ends up footing the bill by helping pay the cost of insulin for its employees through its health benefits plan. The university filed its complaint in the federal district of New Jersey on Jan. 13, naming 21 defendants. The prices of insulin among the three separate groups have increased up to 1000%, down to the same decimal point within days of one another, according to the lawsuit. The lawsuit said the companies sometimes mirror one-another’s prices within days or even hours. Penn State University has standing to sue because it provides cost coverage and reimbursement of insulin for its employees. Its complaint joins the growing number of lawsuits, including one from the Federal Trade Commission, targeting the practices. The university is asking the federal courts to find the companies violated Pennsylvania’s unfair trade practices, committed fraud and engaged in civil conspiracy and unjust enrichment. They’re asking the courts to halt the conspiracy, order the defendants to pay unspecified damages, and pay up to three times the actual damages sustained. One in four healthcare dollars is spent caring for people with diabetes, and ten percent of adults in Pennsylvania have diabetes. The original inventors of insulin sold the patent rights to the University of Toronto for $1, believing anyone would be free to prepare the extract, but no one could secure a profitable monopoly. “Insulin does not belong to me, it belongs to the world,” Sir Frederick Banting, one of the inventors of insulin in 1922 who won the Nobel Peace Prize, is quoted in the lawsuit as saying.
