The case centers on the state's law that mandates abortion patients wait 24 hours before undergoing the procedure to end a pregnancy.
Ohio Attorney General Dave Yost has been fighting the case for months. Abortion advocates are challenging the state law that requires the 24-hour wait period, a second clinic visit and mandated counseling for the patient. Advocates have claimed in the past that the law is a barrier and also a delay for women seeking maternal care who are ready to move forward.Yost said in a court filing that abortion backers are trying to "commandeer the amendment for their own purposes."
"Those guardrails ... worked well before, and so I don't see any reason to change those," DeWine told ABC 6 back in May. Friday at 9 a.m. at the Franklin County Court of Common Pleas, plaintiffs will be seeking a preliminary injunction to stop the state from enforcing the waiting period. They hope the law will ultimately be done with and declared unconstitutional under Ohio's Reproductive Freedom Amendment.
