ESCAMBIA COUNTY, Fla. -- The judge declared a mistrial Wednesday in the murder trial for the mother accused in the Escambia County Home Depot murder.
Sheila Agee's trail began Monday. Closing arguments wrapped Wednesday morning before deliberations began.
One of the jurors expressed to the judge she doesn't feel physically safe due to racial issues. Another juror cited health concerns, telling the court that arguing going on in the deliberation room is raising his blood pressure and could affect his pacemaker.The judge moved jurors into a larger room where deliberations were paused.Another issue that arose: a juror doing a crossword puzzle two days in a row during the trial.
The judge said that is not appropriate behavior and apologized to jury members who faced unpleasantness. "This same juror now in deliberation had another crossword puzzle," the judge said Wednesday. "This same juror now took comments from another juror now as a physical threat for her safety." Sheila Agee, 51, is charged with principle to first-degree murder in the fatal shooting of 18-year-old Brooklyn Sims.Keith Agee shot and killed Sims -- the mother of his 2-year-old daughter -- as she worked inside the Davis Highway Home Depot in August 2023.
