The complaint further stated that Chauvin placed his knee on Day's back, mimicking his later actions during Floyd's arrest. A judge subsequently dismissed the drunken driving charge against Day, ruling that the officers lacked probable cause for the arrest and suppressing the blood alcohol test evidence.Day's attorney, Katie Bennett, expressed gratitude for the settlement, emphasizing that while no settlement can undo her client's experience, it holds the officers accountable. Bennett also highlighted the urgent need for justice and police reform. Chauvin is currently serving a prison sentence at a federal facility in Texas for his convictions in both state and federal courts for the murder of George Floyd and violation of Floyd's civil rights.
