The city of Minneapolis agreed to pay $600,000 to settle a lawsuit filed by Patty Day, who alleges that former officer Derek Chauvin used excessive force against her in January 2020, in a manner strikingly similar to how he killed George Floyd. The city council unanimously approved the settlement, marking another significant payment in the wake of Chauvin's conviction for Floyd's murder.
The city of Minneapolis has agreed to pay $600,000 to settle a lawsuit by a woman who alleges that former Officer Derek Chauvin used excessive force against her in January 2020, in a manner strikingly similar to how he killed George Floyd four months later.
Patty Day, a former Public Works Department employee, filed the lawsuit in May 2022, claiming that Chauvin and his partner, Officer Ellen Jensen, violently removed her from her snow-stuck minivan and threw her to the ground, causing injuries. She admitted to being intoxicated and depressed at the time, but argued that the officers lacked probable cause to arrest her. A drunken driving charge against Day was subsequently dropped after a judge ruled that the officers lacked probable cause for the arrest and suppressed the blood alcohol test evidence. The lawsuit alleged that Chauvin pinned Day to the ground with his knee, mirroring his infamous actions in the death of George Floyd. The Minneapolis City Council unanimously approved the $600,000 settlement on Thursday. Council member LaTrisha Vetaw explained that $175,000 will go to Day, while her attorneys will receive $425,000. This settlement adds to the over $36 million the city has already paid to settle police misconduct cases involving Chauvin, including the $27 million paid to the Floyd family. 'While no settlement can undo what Patty endured, we are grateful to have reached an agreement that holds the officers accountable for their actions,' said Katie Bennett, Day's attorney in a statement. 'This case is yet another example of the critical need for justice and reform in policing.' Chauvin, who is white, is currently serving a 22.5-year sentence for the murder of Floyd in state court and a federal sentence for violating Floyd's civil rights.
