Six migrant criminal cases tossed amid defense claims Operation Lone Star discriminates against men

In court filings for each case, Dubey wrote that the state “had no important, let alone compelling, justification for this discriminatory treatment.” All six defendants whose cases were tossed last week had already been deported by the time Lopez issued his ruling, said Doug Keller, an attorney with the Lubbock Private Defenders Office who is also part of the case. But the legal argument that the program is discriminating against men could serve as a road map for other Operation Lone Star cases, he said.
Deported migrants are also receiving orders from trial courts to appear in person for hearings, creating impossible choices between trying to reenter the country or collecting new charges for not showing, the attorneys argue.
