During a conversation, the agent asked Daly, a Manchester resident, whether he went by any aliases other than those he had provided. Daly suddenly attempted to flee in his vehicle, and the agent pursued Daly at a distance. Daly drove roughly 13 miles along the U.S.-Canada border until he arrived early Sunday morning at the Pittsburg Port of Entry, which was closed to vehicles attempting to cross into Canada. The Border Patrol agent turned on his vehicle’s emergency lights and stepped out of the vehicle to approach Daly when Daly began to turn away. Daly immediately fired a handgun at the agent.Given the Border Patrol’s use of force, the FBI is handling the investigation into the shooting, and Assistant U.S. Attorney Alexander S. Chen is prosecuting the case. Use-of-force incidents involving a firearm are rare, particularly among agents on the U.S.-Canada border.
