An Oklahoma man allegedly sent fake death threats to himself and his wife while framing a former co-worker, authorities said. Cody Underwood, 32, of Claremore, is facing felony counts of stalking, perjury and related charges following his arrest Tuesday for allegedly creating a fake Facebook account to send the threatening messages in an attempt to save his relationship.
Rogers County Sheriff Scott Walton said Underwood even obtained a protective order in February against the man, whom deputies investigated extensively.Walton said Underwood and his wife told investigators in February they had received messages targeting them and the couple's children, including death threats.Underwood later accused a former co-worker of sending the threats, beginning an investigation into the Rogers County man, Walton said.Investigators obtained a search warrant for the man's personal devices, but discovered no evidence linking him to the threats, which continued even after his phone had been seized, Walton said.A group of"good, young sharp investigators" then noticed similarities in some of the threatening messages and verbiage used by Underwood. "So, they sat his ass down and talk to him, and he gives it up," Walton said, referring to Underwood confessing to investigators that he had sent the menacing messages. Underwood told investigators he believed his wife might turn to him for protection amid the harrowing episode, ultimately bringing them closer, Walton said. Following his confession, Underwood then asked deputies if it was too late for the charges he faced to be dropped, according to the sheriff. "It damn sure is," Walton said."I mean, you've tarnished a guy's reputation and caused him damages that you'll never be able to fix. So yeah, it's too late, we know where we're going with this." Underwood, who remains in custody on Thursday on $200,000 bail, is scheduled to appear in court on April 6. It's unclear if he's hired an attorney who can speak on his behalf. He's also facing charges of falsely impersonating another to create liability, computer fraud, threatening to perform an act of violence and false reporting of a crime. Walton, who has served as sheriff in Rogers County for 18 years, said he couldn't recall a similarly confounding case. "We've investigated a lot of false reports, but I don't ever remember one that was plotted out quite this way," he said."This is news to all of us. And it gets into what I'll call the modern-day investigation of social media, you know, I'll create some fake Facebook accounts, and I'll be able to say all this crap and get somebody else — an innocent person — looking down the barrel of a gun." Walton said Underwood managed to obtain a three-year protective order against the man that also bars him from possessing a firearm. "That comes up on background checks, everything," Walton said."He's got a clean bill of health with us, but we're not the keeper of records."
