LIVE | Mkhwebane says she couldn't come to any other conclusion in discredited SARS unit investigation
"We are dealing with you as a public servant, we are not dealing with your attorney, we are not dealing with your legal representation," says Mkhwebane of Ivan Pillay's dealings with the Public Protector during the investigation.Initially, the rules for the removal of a Chapter 9 head said she could be assisted by a legal advisor, but not represented in the committee .
Her refusal to accept the rulings given against her, despite their painstaking reasoning and the fact that they withstood appeal, completely belies her claim that she protects the Constitution. "The Public Protector found that the procurement of intelligence equipment utilised for 'the unit' was improper and therefore amounted to maladministration. The listed equipment in the Report and Rule 53 record are used to seemingly support this as evidence.
What is problematic for Mkhwebane, however, is that she stated that she had the report's findings"on good authority" and used the phrase "apparently" in reference to its existence.Mkhwebane now appears to be suggesting that SARS violated the PFMA with the procurement of alleged surveillance equipment.All the evidence led this morning is an attempt by Mpofu and Mkhwebane to get Parliament to overrule court rulings - or "opinions" as Mpofu calls it.
" The equipment in question was not procured nor used by the HRIU. It was procured in line with SARS procurement policy and used by a unit erstwhile called the Anti-corruption and Security Unit currently known as the Anti-corruption Unit.Mkhwebane says the committee shouldn't rely on the court's finding that she was biased.
