LIVE | Evidence leader requests to question Mkhwebane on Wednesday about CR17, is turned down
Mpofu's"five minutes" has now lasted 13 minutes.Mkhwebane now suggests that there is"professional jealousy" from judges towards her"because they think I want to be a judge".Mpofu says EMEA and the Nkandla judgement, giving the Public Protector binding powers, is a"poisoned chalice". He asks if she agrees that future legislatures should relook at whether the Public Protector's remedial action should be binding. Mkhwebane agrees.
He said he asked the parties in the case to bring a formal application if they wanted the records unsealed.Mkhwebane says as the country is dealing with"so-called state capture, which is a crime", the sealed records leave a"question mark hanging over the president's head". She says it is about ethical leadership.Mpofu asks why Ramaphosa wants the records sealed of the"donors he doesn't know". Mkhwebane says it is something that was done in chambers.
"This means the scope of the power is limited to state affairs and affairs of the public administration. There can be no doubt that the CR17 campaign was engaged in the affairs of the ANC, which is a political party. "But the bright line separating the party from the state remains intact. This is clear from the provisions of the Constitution which establishes three branches of the state. In our system, political parties are represented in the legislative and executive arms of the state. It is a multi-party system. That is why various parties have members representing them in Parliament.
