SAN ANTONIO — The attorney for Adrian Aviles says they are now considering filing a libel lawsuit against Congressman Tony Gonzales following social media posts in which the congressman accused Aviles of attempting to blackmail him.
The dispute comes amid broader controversy surrounding Gonzales's alleged affair with Aviles’s late wife, Regina Santos-Aviles, who served as a regional district director for TX-23.Rumors of an affair began quickly after her death, but this week, new text messages surfaced between Santos-Aviles and another staffer where she admits to the affair with Gonzales. Barrera now says they are evaluating a libel lawsuit because of Gonzales’ public statements accusing Aviles of blackmail.“The issue... is Gonzales's response to it, of saying that that amounted to blackmail,” Maloney said. “That is problematic for Tony Gonzales because that is the accusation of a criminal offense, and that’s a different deal altogether. When you accuse someone of a crime, that brings it to a different level than if you’re just accusing someone of being dishonest, or they did something bad.” The legal dispute follows revelations that the Office of Congressional Conduct — the independent ethics watchdog for the U.S. House of Representatives — sent a letter in November to Adrian Aviles indicating it was reviewing an alleged relationship between Congressman Gonzales and Santos-Aviles.Attorneys for Aviles say the Office of Congressional Conduct requested text messages, emails, and other communications related to the alleged relationship. The Office of Congressional Conduct operates largely confidentially and does not comment on ongoing matters. Investigations typically only become public if referred to the House Ethics Committee. We reached out to Congressman Gonzales’ office to ask whether he had been contacted by the Office of Congressional Conduct and whether any review remains active.Ms. Santos-Aviles was a kind soul who devoted her life to making the community a better place. Her efforts led to improvements in school safety, healthcare, and rural water like never before. It’s shameful that Brandon Herrera is using a disgruntled former staffer to smear her memory and score political points, conveniently pushing this out the very day early voting started.
