Romero-Hernandez, a 27-year-old Mexican citizen, pleaded guilty to a state assault charge and was sentenced to time served, leading to his release.

However, before Immigration and Customs Enforcement (ICE) could take him into custody based on a federal complaint alleging illegal re-entry into the United States, Romero-Hernandez was released by the sheriff's office. ICE, along with the U.S. Marshals Service and Homeland Security Investigations, subsequently arrested Romero-Hernandez. Acting Deputy Attorney General Emil Bove criticized the Tompkins County Sheriff's Office, stating that it appeared to have disregarded a valid federal arrest warrant for a criminal alien with an assault conviction. He commended the U.S. Attorney's commitment to investigate the situation for potential prosecution. In response, Tompkins County and the Sheriff's Office issued a joint statement denying the Justice Department's allegations. They asserted that ICE was informed about Romero-Hernandez's release date and had ample opportunity to retrieve him from the jail without incident. They further claimed that there was no interference with federal immigration enforcement efforts and that the DOJ's accusation that the Sheriff's actions endangered federal law enforcement officers was false and offensive. Meanwhile, Bove instructed all 93 U.S. attorney's offices to prioritize immigration enforcement by allocating more resources to this area. He compared the threat posed by undocumented immigrants to the threat posed by terrorists, signifying a significant shift in the Justice Department's focus, redirecting law enforcement resources away from previous national security priorities
