During a hearing on Tuesday, the defense and state provided arguments in front of state District Judge Joel Perez on whether to quash Brad Simpson's indictment.

A local judge has stalled his decision on whether to throw out Brad Simpson ’s indictment, which alleges he killed his wife, Olmos Park realtor, Suzanne Simpson . The goal of the motion to quash, which was filed by Brad Simpson ’s defense attorney, is to have the judge declare the indictment against Brad Simpson invalid, preventing him from standing trial for the charges. The motion was argued before State district Judge Joel Perez during a hearing on Tuesday.

Judge orders lawyers, witnesses in Brad Simpson case to keep quiet Casey Sandoval, the lead prosecutor in the case, said the state does not need to prove how Simpson killed his wife. She said the state must only prove that Brad Simpson intended to kill his wife and that he caused her death. Sandoval said it is not necessary for the medical examiner to provide Suzanne Simpson’s cause of death to go forward with prosecuting Brad Simpson’s case.

Judge limits contact for Brad Simpson and some of his children By viewing security video, police tracked Brad Simpson to his daughter’s school, a Boerne Whataburger, and a local Home Depot, where he purchased concrete, heavy-duty trash bags, and Clorox disinfectant spray, among other items. The items were visible on his truck bed in the surveillance video. A man told police that Simpson walked up to him in the Home Depot parking lot and asked him where the nearest dump was in Boerne.
