Lawsuit filed by the Protect Our Communities Foundation wanted to toss out the 20-year deal

A superior court judge has largely upheld the controversial electric and natural gas franchise agreements the city of San Diego signed with San Diego Gas & Electric two years ago, turning back a lawsuit filed by a local consumer and environmental group. 'The upshot for us is, largely, disappointment,' said Bill Powers, board member of the Protect Our Communities Foundation, which filed the petition and sought to invalidate the lucrative 20-year franchise agreements.

The monies come from shareholder funds of SDG&E's parent company, Sempra, not ratepayers. The utility also put up $10 million for various programs aimed at increasing access to solar power and rebates for residents living in historically under-served communities. The agreement runs for 10 years and has an automatic renewal for another 10 years — what Mayor Todd Gloria called a “10-plus-10” agreement.
