A federal judge dismissed the classified documents case against former President Donald Trump on Monday, saying the appointment of special counsel Jack Smith was unconstitutional.
Defense attorneys had argued that Mr. Trump should not face trial for taking classified documents to his Mar-a-Lago estate after leaving office because the Justice Department did not have the authority to appoint Mr. Smith, who also investigated Mr. Trump’s post-2020 election actions. Questions about Mr. Smith’s appointment have swirled for months, raised in particular by conservative legal scholars who said Attorney General Merrick Garland stretched the law by appointing him.
