The Illinois Supreme Court has agreed to hear an appeal from actor Jussie Smollett after a ruling upheld his Cook County conviction for lying about an alleged hate crime, court records show.
In 2021, the former Empire TV star was convicted of faking a racist an homophobic attack in 2019 and then lying to police about it.His attorneys appealed, arguing the conviction violated Smollett's Fifth Amendment rights against double jeopardy, which says a person cannot be punished for the same crime twice.
A special prosecutor had brought a new indictment in 2020, after the initial charges were dropped in 2019 in exchange for a $10,000 bond and community service.Smollett's attorney is asking the Illinois Supreme Court to reverse this latest conviction."In this case, Mr. Smollett has given up his $10,00o bail bond, that is a lot of money," Smollett's attorney Nenye Uche said.
