Oscar Aristides Garcia, 35, was sentenced by visiting Judge Marc Brown for the murder of 37-year-old Nicolas Bautista, Harris County District Attorney Kim Ogg announced Saturday.

The shooting on Oct. 28, 2018, occurred as Bautista was in Garcia's Pasadena transmission shop with his girlfriend. The couple was on their way to a restaurant for Sunday brunch when Garcia mistook Bautista for a thief who'd been stealing pickup tailgates from the shop. Garcia broke into the neighborhood taqueria and destroyed its security camera’s recording device as well because the footage possibly showed him following Bautista. He then closed the shop and departed to his native El Salvador.

Nicolas Bautista, 37, was fatally shot by 35-year-old Oscar Aristides Garcia in 2018 after being mistaken for a thief.Assistant District Attorney Ryan Volkmer, who prosecuted Garcia's case, called listening to Bautista’s friends and family testify about losing him"heartbreaking."
