He argued that the cancer, heart problems, and harsh conditions at New York City's Rikers Island jail were taking a toll on him, stating, 'I don't know how much longer I can hold on.
' Weinstein objected to Judge Curtis Farber's scheduling of the retrial for April 15, requesting a swap with another unrelated trial the judge has in March.Weinstein, 72, was undergoing treatment for several health issues, including chronic myeloid leukemia, heart problems, and diabetes. He further complained to Farber that jail officers had mistakenly given him the wrong medication that morning and hadn't transported him to court promptly. Arriving in court over half an hour late in a wheelchair, Weinstein's demeanor at times resembled the domineering studio executive he once was. He implored the judge, 'I'm asking and begging you, your honor, to move your trial,' suggesting even a week's delay would be beneficial. He inquired about the judge's trial schedule, including jury selection for another case set to begin on Monday.Farber acknowledged Weinstein's situation and stated he had chosen the April 15 date after consulting with both the prosecution and Weinstein's lawyers. However, he indicated he would investigate the possibility of starting the trial a few days earlier if time permitted. 'I'm in a serious emergency situation,' Weinstein pleaded with the judge, expressing his desire to 'get out of this hellhole as quickly as possible.' This unusual plea from a criminal defendant came after Farber ruled on a crucial aspect of the retrial, upholding a charge based on an allegation from a woman not included in the original case. Weinstein's legal team had sought to dismiss this additional charge, arguing through their lawyers that the Manhattan district attorney's office had introduced it solely to bolster their case with a third accuser after New York's highest court overturned his initial conviction
