Documents allege a neighbor called 911, stating Whybark was holding a knife and acting strangely before the deputies arrived.
Federal lawsuit claims Snohomish County deputies were 'not justified' in Sultan shooting New documents from a federal lawsuit claim two Snohomish County deputies were not justified in the July 9 shooting that injured a Sultan man and killed his dog.
Court documents allege Whybark was unarmed and seated on the bed of a pickup truck with his hands covering his head when the officers opened fire. Body camera video worn by Snohomish County deputies captured the entire incident on video. The lawsuit named two deputies — Sgt. Carl Whalen and Deputy Kenneth Fredericksen. The claim alleges the deputies failed to deescalate the situation and they shot Whybark “without warning or justification.”
In one of the videos, Whybark appears to pick the knife back up when a second officer arrives and has it in his hand as he climbs onto a pickup.
