A federal judge has halted Elon Musk's Department of Government Efficiency (DOGE) from accessing sensitive Treasury Department records containing personal data of millions of Americans. The lawsuit alleges that the Trump administration illegally granted DOGE access to the Treasury's central payment system, raising concerns about data security and potential disruption of essential federal payments.

WASHINGTON, DC - NOVEMBER 13: Elon Musk listens as U.S. President-elect Donald Trump addresses a House Republicans Conference meeting at the Hyatt Regency on Capitol Hill on November 13, 2024 in Washington, DC. As is tradition with incoming presidents, Trump is traveling to Washington, DC to meet with U.S. President Joe Biden at the White House as well as meet with Republican congressmen on Capitol Hill.

Engelmayer, who was appointed by President Barack Obama, also said anyone prohibited from having access to the sensitive information since Jan. 20 must immediately destroy all copies of material downloaded from Treasury Department systems. The White House previously did not immediately respond to a request for comment on the lawsuit being filed.

New York Attorney General Letitia James, whose office filed the lawsuit, said DOGE's access to the Treasury Department's data raises security problems and the possibility for an illegal freeze in federal funds. Also on the lawsuit are Arizona, California, Colorado, Connecticut, Delaware, Hawaii, Illinois, Maine, Maryland, Massachusetts, Minnesota, Nevada, New Jersey, North Carolina, Oregon, Rhode Island, Vermont, and Wisconsin.

"This decision failed to account for legal obligations to protect such data and ignored the privacy expectations of federal fund recipients," including states, veterans, retirees, and taxpayers, the lawsuit says.
