Haas, the driver involved in the accident, acted with negligence, carelessness, and recklessness during the incident.
They claim that Haas failed to exercise the necessary level of care while operating her vehicle, leading to the devastating consequences. The lawsuit details the events of December 19, 2024, when Haas' vehicle, positioned in the pickup line during holiday performance dismissal, suddenly accelerated, colliding with another car and propelling both vehicles through a fence and into the school's playground. Five children, including Amrani, were hospitalized as a result of the crash. Rosales, the young teacher, tragically died at the scene. At a press conference following the accident, Bexar County Sheriff Javier Salazar suggested that Haas may have a medical history that contributed to the incident, but this information is not explicitly addressed in the lawsuit or Haas' response.The families of the victims further accuse Excelled Montessori Plus School of negligence in maintaining adequate safety measures for the children. They argue that the school failed to install proper and adequate barriers between the parking lot and playground, had insufficient fencing, and lacked adequate safety protocols. These alleged shortcomings, they believe, directly contributed to the deaths of Amrani and Rosales. In seeking compensation for their losses, the families are requesting damages exceeding $1 million to cover physical and emotional pain, medical and funeral expenses, and the profound loss of companionship. In addition to the lawsuit, the families have reached out to San Antonio state representative Ray Lopez, urging him to support their proposed ordinance, the “Amrani-Rosales Safety Ordinance.” This legislation aims to prevent future tragedies by establishing safety requirements and standards for all licensed childcare centers in Bexar County. The ordinance would mandate the installation of physical barriers, such as bollards, concrete planters, or protective structures, to safeguard playgrounds, entrances, exits, and areas where children and staff congregate. Furthermore, the ordinance would require adherence to specific placement and design standards for these barriers, ensuring their effectiveness while maintaining accessibility and aesthetic compatibility with existing infrastructure. To enforce compliance, the ordinance proposes designating an enforcement authority, such as the county’s building and safety department, with the power to impose penalties or fines for noncompliance, including the suspension of operating licenses
