Lawmakers have subpoenaed Robert Roberson to appear before the House Committee on Criminal Jurisprudence on Monday, three days after Thursday’s scheduled execution. It led to the hearing in a Travis County courtroom that ultimately led to a temporary restraining order. It was not the only avenue Roberson’s attorneys were trying.

“It was presumed that if there were certain conditions observed in a young child which involved bleeding in the eyes, bleeding in the brain, brain swelling, that those three conditions referred to as the triad were presumptive of abuse,” Potkin explained. “Unknown at the time, but known now, she was dealing with two different types of pneumonia, both viral and then it turned into bacterial and was fatal.

“He's an innocent man, and we are very close to killing him for something he did not do,” Wharton said Wednesday.
