The lawsuit was filed in California, with Sánchez, publisher of the Collective Book Studio and distributor Simon & Schuster, all named in the claim. Zabel alleges the two discussed the idea of creating a children’s book together after Sánchez told her a story about a helicopter trip where a fly was stuck to the windshield the entire time. Zabel had written children’s books before, so the two discussed making this story into a possible book. “It’s paralyzing to watch a former client with a vendetta against you who marries the richest guy in world, then takes your heart’s passion and pretends it’s hers,” Zabel also told The Post. She also claims Sánchez cut off contact from her in 2009, after she upstaged her on her 40Sánchez’s attorneys responded that the “claim is frivolous,” according to an August court filing. “The Works are not similar other than the fact that they are both children’s books that involve a spontaneous trip to space,” the response read. Zabel “does not own the concept of a school-age character unexpectedly taking a trip to and from space,” lawyers also argued. Plus, the response notes that Zabel “attacks with irrelevant allegations that she is jealous of Plaintiff, ‘harbor resentment towards,’ and is out ‘to exact revenge’ or is ‘trolling’ Plaintiff.” “Those allegations are irrelevant to a copyright infringement analysis, but are clearly intended to color this Court against Ms. Sánchez in the hope that it will think there is no smoke without fire.
