District Judge Algenon Marbley agreed on Friday to terminate Tommy Thompson’s sentence on the civil contempt charge, stating that he “no longer is convinced that further incarceration is likely to coerce compliance.” He also ordered that the research scientist immediately commence serving the two-year term he received for the criminal contempt charge, a sentence which had been delayed when the civil contempt term was imposed. Thompson’s case stems from his discovery of the S.S. Central America, known as the Ship of Gold, in 1988. The gold rush-era ship sank during a hurricane off South Carolina in 1857 while carrying a vast amount of gold. Thompson has been accused of withholding information about approximately 500 gold coins minted from some of the recovered treasure, valued at around $2.5 million. He has previously claimed, without providing specifics, that the coins were transferred to a trust in Belize. Thompson’s failure to appear for a 2012 Ohio hearing regarding the coins led to his eventual tracking down and arrest by U.S. marshals in Florida in 2015. Federal law typically caps jail time for contempt of court at 18 months. But a federal appeals court in 2019 rejected Thompson’s argument that this law applied to him, asserting that his refusal violated the terms of a plea agreement. Since December 15, 2015, Thompson has been incarcerated for civil contempt, incurring a daily fine of $1,000. Judge Marbley determined Thompson’s total civil contempt fine to be $3,335,000.
