Jim Pruitt, a former Dallas County criminal judge, heard arguments Tuesday on a motion, who prosecutors have said is not impartial in the murder case against Nina Marano and is biased against lead prosecutor Robin Pittman.
“We believe was expressing her frustration with what was going on – simply being frustrated because basically, your honor, the state was not following through,” defense lawyer Valerie Baston said to Pruitt. Pruitt, who noted that he was visiting from Rockwall, did not rule on the recusal at the end of the hearing. Hehe expects to do so Friday, said Jennifer Balido, a chief in the Dallas County district attorney’s office who wrote the recusal motion.
In response to that, defense attorneys said she did so because she established those hearings, and judges ask questions all the time. Balido said she didn’t delay or wait until the last minute to file the motion to recuse Givens. Prosecutors filed it March 16, which was 11 days before Marano’s trial was to begin. State law requires a party to do so no less than 10 days before the date set for trial.“When a judge starts talking, they start showing their bias. They start showing what’s going on in their head,” Balido said.
