Cutting red tape for Dallas-Fort Worth food trucks

They were aware of the bill, sponsored by Rep. Giovanni Capriglione, R-Southlake, during the recent legislative session, but thought it would only apply to Tarrant County. So did Tarrant County officials, according to Assistant County Administrator Russell Schaffner, who worked with Capriglione.

Yet when the so-called “bracket bill” was narrowly written to apply to Tarrant County, it also ensnared Dallas County. The bill states that it applies only to any county with a population of more than 2.1 million, that contains fully or partially a commercial airport, and contains a noncommercial airport owned by the principal city in that county. Only two Texas counties fit that description: Dallas and Tarrant.

Now Dallas County Health and Human Services Director Philip Huang is rushing to set up an inspection program for an estimated 1,000 food trucks, he told commissioners at a special called meeting on Aug. 29. He requested an initial $50,000 to get the program off the ground, an allocation commissioners approved with furrowed brows.All of this comes as Dallas County is struggling with a swelling jail population, payroll delays and allegations of neglect at its juvenile detention center. County Judge Clay Jenkins recently said the state of the county was “a mess.”

Still, we’re keeping our fingers crossed that the county comes up with a smooth process to comply with this surprising new law. Despite the clumsy way it was established, HB 2878 makes good sense and will leave food trucks with more money to make street tacos, barbecue and other popular fare while, we hope, cutting some of the red tape that ties up small businesses.
