KOTA KINABALU: The government should enact a law to address legal issues that are likely to arise from breaches of contract during the movement control order (MCO) period, says the Sabah Law Society.

The legal body suggested that a Covid Measures Act be tabled either in Parliament or the various state assemblies to mitigate potential suits that may arise from breaches of that occur during the MCO.

He said putting in place a law to avoid litigation over breaches of contract was important to focus on rebuilding the economy at this critical juncture. This will not only be detrimental to the individuals involved, but will also increase the uncertainty in the economy generally, as parties will not know for sure where they stand until the litigation is finally resolved, Chin said.

Chin said that provisions could be made via a single Act of Parliament and/or State Enactment where applicable. “Relevant obligations include contractual obligations and deadlines prescribed by any statute or subsidiary legislation or rules, whether State or Federal, ” he said.
