A federal judge Wednesday revoked the supervised release term of a former Daphne doctor charged with perjury, but the defendant will not have to do additional jail time.

Rassan Tarabein, 66, has been serving a term of supervision following his prison sentences in a pair of federal criminal cases. Chief U.S. District Judge Jeffrey Beaverstock ruled that Tarabein’s new arrest on state perjury charges constituted a violation of his release.

But the judge sentenced him to the three-plus hours he spent at Mobile County Metro Jail before bailing out on his latest charges. The judge imposed a new four-year supervised release term and ordered that the first six months be spent on house arrest and electronic monitoring. “We were really grateful for the second chance for Dr. Tarabein,” defense attorney Josh Briskman said. “I think it was fair. You know, he does have some new charges, but they are misdemeanors. And it basically pertains to him trying to correct the spelling of his name. That’s what this was all about, and that’s why he filed the petition.” Tarabein, who now lives in Mobile, was living in Daphne and had a pain management practice on the Eastern Shore. He pleaded guilty in 2017 to Federal law enforcement authorities arrested Tarabein on those charges as he was waiting in Pensacola to catch a flight to Syria. A jury convicted him, and a judgeMobile County prosecutors allege that Tarabein went to the Mobile County Probate Court to apply to legally change his name. Investigators cite five statements they allege were false – that he was not a party to any judicial proceeding, not a defendant in any criminal case and not seeking to conceal his identity. Investigators also allege that Tarabein stated that he was not attempting to avoid payment of any debt or judgment and that he hadn’t been convicted of a felony. Briskman said his client had no nefarious intent with the name change and suggested it was a misunderstanding. He said Tarabein has some “conditions” that explain why he did not read the document closely or understand it. “He is not from this country, and at some point over here, his name was spelled incorrectly, and that caught on in documents and official records,” he said. “And he wanted to correct that. … He was careless.”“It was just a mistake,” Briskman said. “There wasn’t anybody harmed, but he has withdrawn that petition, and he will take steps, I believe, to do it the right way shortly. … We’ll make a stab at trying to settle it. But if we have to try it, that’s OK, too.
